Terms and Conditions

1. Definitions

In these Terms and Conditions:

• “Company” refers to The Cotswold Hay Bale Company 
• “Hirer” refers to the person, company, or organisation making the booking
• “Equipment” refers to all items hired by the Company

2. Agreement

By placing a booking with the Company, the Hirer agrees to be bound by these Terms and Conditions. No variation shall be valid unless agreed in writing by the Company.

3. Bookings and Payment

• A booking shall only be deemed confirmed upon receipt of a deposit or full payment.
• The balance must be paid in full prior to delivery, unless otherwise agreed in writing.
• The Company reserves the right to cancel or withhold delivery of Equipment where payment has not been received in accordance with these terms.

4. Hire Period

• The hire period shall be as agreed at the time of booking.
• The Hirer shall ensure that the Equipment is available for collection at the agreed time and location.
• The Company reserves the right to charge additional fees for late return or failure to make Equipment available.

5. Delivery, Installation, and Collection

• Delivery and collection times shall be agreed in advance; however, such times are estimates and may be subject to reasonable delay.
• The Hirer is responsible for ensuring safe, suitable, and adequate access to the delivery location.
• The Company reserves the right to charge for additional time, waiting, or failed delivery/collection due to restricted access or delays caused by the Hirer.

6. Use of Equipment

• The Hirer shall be responsible for ensuring that all Equipment is used in a safe and proper manner.
• Equipment must only be used for its intended purpose and must not be altered or modified in any way.
• The Hirer shall ensure that Equipment is not left unattended in unsecured or public areas.
• The Hirer shall take all reasonable steps to protect Equipment from damage, including adverse weather conditions.

7. Responsibility, Damage, and Loss

• The Hirer accepts full responsibility for the Equipment from the time of delivery until collection.
• The Hirer shall be liable for any loss, theft, or damage (excluding fair wear and tear).
• The Company reserves the right to charge the Hirer the full cost of repair or replacement where Equipment is damaged, lost, or stolen.

8. Cancellations and Refunds

• All cancellations must be made in writing via email.
• Deposits are non-refundable.
• Where cancellation occurs within 3 days of the hire date, the Company reserves the right to charge 50% the full balance.
• In the unlikely event that the Company must cancel due to circumstances beyond its control, a full refund shall be provided, and no further liability shall be accepted.

9. Weather Conditions

• The Hirer acknowledges that Equipment intended for outdoor use is subject to weather conditions.
• The Company shall not be liable for adverse weather, and no refunds shall be issued on this basis.
• The Hirer is responsible for providing suitable cover or an alternative indoor space where necessary.

10. Liability

• The Company shall not be liable for any injury, loss, or damage arising from the use or misuse of the Equipment.
• All Equipment is used entirely at the Hirer’s own risk.
• Nothing in these Terms shall exclude or limit liability where it is unlawful to do so.

11. Insurance

The Hirer is advised to obtain appropriate insurance to cover hired Equipment and any associated risks during the hire period.

12. Force Majeure

The Company shall not be held liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, extreme weather, accidents, or transportation issues.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
